Florida employees have various rights under state and federal laws, including the right to a safe workplace, protection from discrimination and harassment, and eligibility for overtime pay. The state minimum wage is currently higher than the federal minimum wage. Additionally, Florida law provides for specific protections like the right to file a workers' compensation claim if injured on the job and protections for whistleblowers who report legal violations by their employers.
Employers cannot legally terminate employees for reasons that are discriminatory (based on race, color, religion, sex, national origin, age, disability, or genetic information), retaliatory (for reporting violations of law or participating in an investigation), in violation of labor laws, or employment contract violation. For example, if a contract states that an employee can only be terminated for poor performance after receiving three written warnings, firing the employee after just one warning would be a violation.
The duration of an employment law case can vary significantly depending on the specifics of the case, including the complexity of the issues involved, the willingness of parties to negotiate, and the court's schedule. It can range from a few months to several years. Consulting with an employment lawyer can provide a more accurate timeline based on your specific situation.
The cost of hiring an employment lawyer can vary widely based on the complexity of the case and the specifics of your situation. Nonetheless, Obeidy & Associates, PA is paid a percentage of your settlement if we win on your behalf. While our firm requires a retainer, we strive to accommodate your financial situation and may allow you to pay this retainer at the end once you receive your settlement. To ensure you understand your case and potential costs upfront, we provide a free consultation to discuss your situation and outline a personalized legal strategy. This way, you can access quality legal representation without the upfront financial burden, allowing you to focus on achieving a successful outcome.
An employment lawyer specializes in handling legal issues related to the workplace, such as wrongful termination, discrimination, wage and hour disputes, workplace safety, and employment contracts. They provide legal advice, represent you in court, and help negotiate settlements.
